At Overtake Media, we don’t just deliver services — we deliver outcomes. This Fulfillment Policy explains our commitment to ensuring you see results from the work we provide. We are a performance-driven marketing partner incorporated under the laws of Ontario, Canada, operating in accordance with all applicable federal and provincial regulations.
2. Our Guarantee to You
We back our services with a 30-Day Performance Guarantee, starting from the completion date of your initial deliverables (the “Service Completion Date”). If measurable, profitable results are not achieved within 30 days of that date, we will continue delivering support—at no additional cost—until we get your business where it needs to be.
3. What We Mean by “Profitable Results”
‘Profitable results’ are defined as tangible, trackable improvements in key business metrics such as:
Increased lead generation
Higher conversion rates
Enhanced ROAS or sales growth
Notable website traffic improvements
— as a direct result of our executed campaigns, systems, or strategies.
4. How to Submit a Guarantee Request
If you believe the agreed-upon results haven’t been met, here’s what to do:
Submit a written request within 40 days of the Service Completion Date.
Include performance data or evidence demonstrating that profitable results were not achieved.
Allow us full access to verify your claim, including analytics and relevant platform performance.
5. Our Guarantee Commitment
If we confirm the claim meets the criteria, we’ll take the following action:
Deliver additional services at no extra cost.
Scope and timeline will be mutually agreed upon.
Fulfillment efforts will remain focused strictly on achieving the originally defined performance benchmarks.
6. Limitations of the Guarantee
Our performance guarantee is built on transparency and fairness, but it’s subject to the following conditions:
It applies only to quantifiable business outcomes, not subjective dissatisfaction.
It does not cover indirect losses, delays caused by the client, or force majeure events.
It is non-transferable and available solely to the original client listed in the initial agreement.
It does not apply if the results were impacted by external changes beyond our control (e.g., algorithm shifts, major economic downturns, platform policy changes).
7. Governing Law
This policy will be governed by and interpreted in accordance with the laws of Ontario, Canada. All disputes will fall under the jurisdiction of courts located within Ontario.
